Chemical Importers Obligations Under EU Regulations

Key Responsibilities of EU Importers Under Chemical Regulations

Under EU Chemical Regulations, companies importing chemical products from outside the EU must fulfil several obligations before accessing the EU market. The Health and Safety Authority (HSA) in Ireland oversees compliance with these regulations, specifically under the REACH, CLP, and Prior Informed Consent (PIC) Regulations.

REACH Regulation

The Registration, Evaluation, Authorisation, and Restriction of Chemicals (REACH) Regulation requires importers to:

  • Register Substances: Any substance imported in quantities of one tonne or more per year must be registered with the European Chemicals Agency (ECHA).
  • Safety Data Sheets: Provide and maintain up-to-date safety data sheets for all hazardous substances and mixtures.
  • Risk Management: Implement and communicate risk management measures to ensure safe use of chemicals throughout the supply chain.

CLP Regulation

The Classification, Labelling, and Packaging (CLP) Regulation mandates that importers:

  • Classify Chemicals: Determine if a substance or mixture is hazardous based on CLP criteria.
  • Label and Package: Ensure all hazardous substances and mixtures are correctly labelled and packaged to communicate risks and ensure safe handling.

PIC Regulation

The Prior Informed Consent (PIC) Regulation requires importers to:

  • Notify Authorities: Inform the relevant authorities about the import of chemicals listed in Annex I of the PIC Regulation.
  • Obtain Consent: Secure consent from the importing country before exporting certain hazardous chemicals.

By adhering to these regulations, EU importers help maintain high safety standards for chemical products, protecting both human health and the environment.
